Terms of Service

Before you register for a Joocer account, you must read and agree to Joocer's Policies.

Description of Service

Joocer is an Email system with a HTTP (web) interface. Similar systems are frequently referred to as web mail systems.

Registration Obligations

  1. You agree to provide true, accurate, current and complete information about yourself when registering to use Joocer.
  2. You agree to update and maintain the information provided at registrations to ensure it remains true, accurate, current and complete.

Member Conduct

  1. You agree to use Joocer only for lawful purposes.
  2. You agree to use Joocer within the spirit of these rules and policies.

We reserve the right to deny a service to users or messages if:

  1. They are racist, sexist, homophobic, sexually explicit, abusive or otherwise objectionable.
  2. They harm minors in any way.
  3. They impersonate any person or entity, including, but not limited to, a Joocer employee.
  4. They imply or state a relationship to or authority from, including, but not limited to, a Joocer employee.
  5. They break the law or condone or encourage unlawful activity.
  6. They are considered to be spam.
  7. They are believed to contain a virus or other malicious software or scripts.
  8. They interfere with or disrupt Joocer's normal service, servers or networks.
  9. They are collecting or harvesting information about others.

If you break these rules

On breaking these rules you will be sent a message from the administrator stating what terms have been broken.

Repeated failure to follow the rules or a significant breach of these rules will result in your account being put in a permanent or temporary suspended state where you will be unable to access some or all of Joocer's services.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  1. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOOCER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
  2. JOOCER MAKES NO WARRANTY THAT:
    1. THE SERVICE WILL MEET YOUR REQUIREMENTS,
    2. THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,
    3. THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE,
    4. THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND
    5. ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
  3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA OR OTHER LIABILITY THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
  4. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM JOOCER OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT JOOCER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JOOCER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

  1. THE USE OR THE INABILITY TO USE THE SERVICE;
  2. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE;
  3. UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  4. STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR
  5. ANY OTHER MATTER RELATING TO THE SERVICE.
